Terms & Conditions

Junk Removal Service Agreement between ET Junk Solutions LLC and the customer identified on the estimate, invoice, or work order.

1. Scope of Services

Customer authorizes ET Junk Solutions LLC to remove, haul, transport, donate, recycle, and/or dispose of items identified during the estimate and approved by Customer.

ET Junk Solutions reserves the right to refuse removal of any item that presents a safety, legal, environmental, or disposal concern.

2. Customer Ownership and Authority

Customer represents and warrants that:

  • Customer owns the items being removed or has legal authority to authorize their removal.
  • No items provided for removal are stolen, subject to a lien, involved in a legal dispute, or owned by another party without permission.
  • Customer will indemnify and hold ET Junk Solutions harmless from claims arising from unauthorized removal requests.

3. Prohibited Items

ET Junk Solutions does not accept, transport, or dispose of:

  • Hazardous chemicals
  • Paints, solvents, or thinners
  • Gasoline, diesel fuel, kerosene, or other fuels
  • Motor oil or automotive fluids
  • Propane tanks
  • Asbestos-containing materials
  • Medical waste or biohazards
  • Explosives, ammunition, or firearms
  • Radioactive materials
  • Unknown liquids or unidentified hazardous substances
  • Any material prohibited by local, state, or federal law

4. Pricing and Payment

Pricing may be based on volume, weight, labor, loading difficulty, disposal costs, travel, or a combination thereof. Customer will receive pricing approval before work begins.

Payment is due immediately upon completion of services unless otherwise agreed in writing. Accepted methods may include cash, credit card, debit card, and electronic payment platforms.

Unpaid balances may be subject to collection costs, attorney fees, court costs, and applicable interest as permitted by law.

5. Access to Property

Customer agrees to provide safe and reasonable access to all areas where items are located. Customer is responsible for:

  • Unlocking gates and doors
  • Securing pets
  • Identifying items to be removed
  • Ensuring adequate workspace

6. Property Damage Limitation

ET Junk Solutions will exercise reasonable care while performing services. Moving large, heavy, or bulky items may involve inherent risks including scratches, dents, scuffs, and damage to walls, floors, driveways, landscaping, or fences.

ET Junk Solutions shall not be liable for pre-existing damage or concealed defects. Any claim for alleged damage must be reported before ET Junk Solutions leaves the job site.

7. Weather and Safety

ET Junk Solutions may delay, reschedule, or stop services due to severe weather, unsafe conditions, hazardous materials, structural concerns, aggressive animals, or any condition posing risk to employees, customers, or property.

8. Abandoned Property

Once Customer authorizes removal and items are loaded onto ET Junk Solutions vehicles, ownership transfers to ET Junk Solutions. ET Junk Solutions may donate, recycle, resell, salvage, or dispose of removed items at its sole discretion. Removed items cannot be returned once loading begins.

9. Donation and Recycling

ET Junk Solutions may attempt to donate or recycle eligible items but makes no guarantee that any item will be donated or recycled. Disposal decisions remain solely at ET Junk Solutions' discretion based on facility acceptance, condition, and practicality.

10. Photographs and Marketing Authorization

Customer grants ET Junk Solutions permission to photograph work areas, removed materials, and completed results for documentation, training, insurance, quality control, and marketing purposes. No personal identifying information will be intentionally disclosed without additional permission. Customer may opt out by notifying ET Junk Solutions in writing before work begins.

11. Limitation of Liability

To the maximum extent permitted by law, ET Junk Solutions' liability for any claim arising from services provided shall not exceed the amount paid by Customer for the specific service giving rise to the claim. ET Junk Solutions shall not be liable for indirect, incidental, consequential, special, or punitive damages.

12. Indemnification

Customer agrees to indemnify and hold harmless ET Junk Solutions, its owners, employees, and contractors from claims, damages, losses, or expenses arising from:

  • Customer's breach of this Agreement
  • Customer's misrepresentation of ownership
  • Presence of prohibited materials
  • Unsafe conditions at the property

13. Governing Law

This Agreement shall be governed by the laws of the State of Indiana. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located in Indiana.

14. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions, estimates, or representations not contained herein.
